The standing question alone should have ended the lawsuit.


The notion that Congress can sue the executive in federal court because they disagree with the executive's interpretation of a vague statutory provision is just plain absurd. My guess is the DC Circuit rules on that issue and doesnt even touch the merits.

On funding, their argument is weird and tortured too. Medicaid and Medicare are not funded by Congressional appropriations and there is no reason to believe this was designed to be any different. Of course, when those laws were passed there wasnt an opposition party of petulant children filing a lawsuit a week trying to undermine them.
