…particularly so in cases involving the presidential election, as the final arbiters there are states legislatures and then Congress. Courts have no role in conducting or certifying elections.
Courts, of course, are also not “arbiters” at all when they refuse to arbitrate the issue at hand, as happened in 2020 when courts simply punted.
