I’m no criminal defense lawyer, but seems to me a core constant of
Defense strategies is “delay delay delay”. So, what law would address that?
I would like an ideal legal system that does not favor those with money. In my perfect world, everyone would have access to a great defense, facing off against honest but vigorous prosecutors, and trials would start the day after an arrest.
But we live in a human world. I doubt we’ll ever get to perfect - got access to money, you got access to the best defense attorneys. Otherwise, you don’t. I don’t know where all this money to guarantee speedy trials will come from, but I doubt it would change defense strategies or eliminate all logjams. Probably line a lot of pockets though.
So I’m guessing with or without cash bail, we’ll have issues with people committing crimes while suspected of prior crimes. A challenge of “innocent until proven guilty” I doubt we can ever fully solve. Not unless we want to be a totalitarian state. [Post edited by hoolstoptheheels at 03/30/2024 09:12AM]
