…a tough subject for a couple of reasons. First, if you can’t make bail, then you are imprisoned without trial, which is obviously problematic. Second is a reason you mentioned, which is a potential discrepancy in how the jaw is applied based on ability to pay, which is also unfair.
The solution to me is to massively increase the resources we allocate to the criminal justice system so that people can have their cases heard in a reasonable amount of time. A guy charged with burglary, for example, shouldn’t wait two users for trial — he shouldn’t be languishing in jail for that long if he can’t make bail (or is denied bail), nor should he be roaming the streets for two years, as he is potentially dangerous.
