That's fair. So two things. First, don't make the argument that the Court
produced its own cultural definitions in Roe, but not in Obergefell. It isn't true in either case. Second, Roe had some other precedents such as Griswold, that hinted at a right to privacy, which the Court finally recognized in Roe, even though that right in the case of abortion was not absolute.
Are you prepared to say that Americans don't have a right to privacy? Because, the Court certainly suggested that in Dobbs.
