There’s a solution to this … you write a bill and get it signed into law
It’s a bizarre take that seems to have come to life like 15-20 years ago that everything must be either a constitutional right or banned. Our most basic rights are constitutionally protected, and the legislature gets to decide the issues that actually affect our lives. I don’t deny that abortion affects a lot of people … and I’m pro-choice myself (to a point) … but it’s a flat out magic act to claim that it’s a constitutional right. There’s no constitutional right to marriage, either (AFAIK), but there is a constitutional right to equal protection under the law. So as long as Alabama is going to recognize opposite sex marriage contracts, they’ll have to recognize same sex marriage contracts.
