I do think the public / private distinction matters here - as you point out


These are private institutions and, thus, don't have the same legal obligations to allow speech that a public school does. However, the best policy would be for them to simple say, we allow free speech to the full bounds of what is constitutionally permissible under the First Amendment.

To be even more clear, students, if the Philadelphia Police cannot constitutionally arrest you for your speech, then you will not be punished by Penn.

A march explicitly calling for genocide. Awful, vile, hateful, embarrassing, inappropriate, ugly, terrible reflection on those involved - you can think less of them for the rest of their lives. But is should be constitutionally protected and a university should allow it just as much and in the same places it would allow a student organized and led rally to promote wearing pink hats or to sing Christmas carols.
