The less well-heeled among us. There are examples where judges set no bail for rich suspects they consider to be flight risks. But again, addressing this unfairness by completely ignoring the public safety element of repeat offenders, or those with strong evidence against them, released almost all the time as a matter of course, because blanket requirements that suspects be incarcerated are probably unconstitutional, ignores the public safety factor.

Cash bail allows for innocent until proven guilty with the possibility of applying strong incentives for suspects to show up for court dates. I think “no cash bail” ignores all the many concerns, except the one you’re focused on. And it’s a proven political headwind. Which should also matter in politics.
