I go back to the police example with 'refusing to do their jobs'


Cops see crimes being committed every day. They have to choose whether it's worth putting that individual through the criminal jstice system. I wouldn't consider a cop who is looking for speeders 'not doing his job' for letting people go who are driving 5 mph over because he is waiting to bust someone who is going 10 mph over the speed limit.

I'd see the same thing here. Technically being in the country without the proper paperwork is a crime. But, if that's the only crime that person has committed, is it worth putting that person through the criminal justice/immigration system? I wouldn't see an issue with an INS officer not using his resources on those people and instead using his resources to work on immigrants who have committed crimes other than just being here.

That is different than denying someone his constitutional rights.
