Arguments in this case. Kavanaugh basically said the same thing as KBJ - govt talks to media about risks of various stories (like breaking a story prematurely with Nat’l security implications) all the time, and the plaintiffs contemplate too broad an interpretation of the 1A when they claim that’s out of bounds. I think the gop challengers are going down 6-3, or maybe 7-2, in this case.
Several other interesting cases about the 1A this term - the ACLU defending the NRA in its assertions nys regulators got state financial institutions to tighten the screws over politics. And the cases involving states forbidding private platforms from regulating content as they see fit. I bet the NRA, at least, will win its case.
