I don't share you belief that politicians would always impeach under those
circumstances, but the larger point is that giving Congress the power to control criminal prosecutions is inherently dangerous. There are plenty of protections from prosecution a President has, and a blanket determination of immunity seems like a bad idea. Trump will still be able to raise any applicable immunity claims, but a blanket immunity is antithetical to the "nation of laws, not of men" idea.
At the end of the day, Trump only raised this issue to run out the clock, and he has received that benefit. Time to move on until he cooks up another silly appeal to waste court time and hurt the nation.
I'm all for due process, but Trump is not a good faith litigant. He still gets due process, nonetheless, but that doesn't mean that people not involved in the case can't call bullshit on him.
