Also a good practical point -- it makes no sense to pursue a deficiency

Against some bankrupt person who couldn't pay his mortgage. By the time you or I have drafted the complaint the trustee or bank has already spent more than they'll get back on legal fees. Only seen it in cases involving fraud or strategic default (or commercial cases).

Really a silly point to make even if if there is no deficiency protection at all (e.g., MD and VA).
