Path of indicting presidents, it’ll become a regular tool bitter rivals use against each other in an endless cycle. I think it was sort of the opposite of your concern - yes, for 230 yrs this hasn’t been a problem, because we haven’t opened that Pandora’s box. Once we do, watch out.
I think it’s the Trump presidency and clumsy coup attempt in ‘20 which is different, and I think the cases looking at that specifically are crucial. Because Trump’s utter disregard for the primacy of courts in resolving our disputes, and then the peaceful transfer of power were unique and must not be repeated. So, Alito’s reasoning didn’t resonate with me.
But nobody thinks Trump’s assertions of blanket immunity will prevail. Seems the Court will reject that argument and kick it back down for more clarity on which actions exactly were outside the scope of official duties. The big risk is right now all indicators are leaning Trump. Delays are not terribly unlikely to lead to the case dying on the vine after Jan 20.
