The whole article. The government is not accusing the company of racism. Is it saying that background criminal checks are discriminatory. They are saying that how she is using it is resulting in disparate impact. It doesn’t really offer much more detail than that. Is that disparate impact because they use it as a past fail and a higher percentage of non-white people have criminal backgrounds, then white people? Or are they doing background checks or using the results
of those checks differently for non-white people
than for white people?
