President cannot be prosecuted for carrying out his constitutional role, executing the laws as the state of the chief executive, but anything outside that role, i.e. his personal businesses, political campaign or inciting his political followers to physically interfere with Congress, unless authorized by law, is outside his role.

The same for Congress, they can’t be prosecuted for passing a law, as is their role under the constitution. or the judiciary, a judge can’t be prosecuted for ruling on a legal controversy that comes before him for her.

Trump’s actions post 2020 election leading up to January 6 that he’s being prosecuted, for we’re not caring out his role as chief executive faithfully (even if incorrectly) executing the laws of the state, but furthering his political campaign, and therefore should not be subject to any kind of immunity.
