Hideki Tojo for instance did not actually behead British, Australian, and American POWs himself but he helped provide the environment for it to become a common practice. Justice was served only after the war was lost for the Nazis and Japanese, and for many of them the off ramp was a hangman's noose. So, semantics had nothing to do with their convictions, sentences, and in some cases, executions. It was a matter of the evidence, however.

Frankly, I don't understand your suggestion that somehow the US is negotiating with Russia regarding the conflict there, as if what we say offers a way out or not. To my knowledge the negotiation have been directly, between Ukraine and Russian representatives and no one else. Zelensky has referred to this as genocide and war crimes, yet (bad faith) negotiations continue.
