Sorry, but you don't seem to get the issue. The conservatives are the


ones who say that courts should defer to the will of the people through acts of legislature when it suits their needs. Then they do an about face when it doesn't. You're essentially making my point for me.

On your last point if you mean Lopez and Morrison then (1) those are the ONLY two times a law was struck down for lack of commerce clause authority in the last century, and (2) neither has ANYTHING to do with interstate commerce -- one was a guns in school zones law and the other part of the violence against women act, both of which had incredibly tortured nexuses to interstate commerce.

Much different than regulating 1/5 of the national economy I'd say.
