That aside, whether Cannon's order was legally correct -- which is fairly disputed -- has nothing to do with being "pro-Trump". It has to do with the unprecedented nature of the case involving not only a former POTUS and current candidate but a former POTUS and current candidate being prosecuted banana republic-style BY HIS OWN OPPONENT.

The issues that she raised (covered by Tribe in his opinion piece) are both valid and already proven. The documents in question are going to be reviewed in exactly the fashion that the Special Master would have reviewed them. It's not a question of whether there will be a review and a challenge, but when. And Smith is fucked.

Cannon -- presciently -- understood that 1) this case likely can't and won't go to trial, 2) the DoJ is proceeding with a corrupt as fuck prosecution of a political enemy and 3) Trump faced irreparable damage from the illegal raid on and seizure of his property (which has indisputably already occurred with the illegal leaks from Smith's team to the press).

Hence, it made both good judicial sense -- both in the sense of actual justice and the case itself -- to address the evidence question as early in the process as possible. The appeals court ruled that she jumped the gun on this, and that's fine -- I don't have a problem with them overturning her based on timing. But the issues she raised are fatal to the case. Her effort to make this clear on the front end and enable an innocent defendant to avoid this corrupt and destructive process were thwarted, but only temporarily.
