Smith is in the same boat -- he's got insufficient evidence and no crime, which is why he is hiding discovery and refusing to specify the particulars of the alleged crime. To get a real conviction, he'll eventually have to try his case in an actual courtroom instead of the friendly media. He's T-O-A-S-T.
