Correct. It balances the First Amendment with tort law; if you write a

story about a random person who is not a public figure, that standard doesn’t apply (just plain negligence). If it’s a public figure that can be expected to be reported on, then you use actual malice.

I understand the “malice” component to be more “you knew this shit was a lie or just ignored all the red flags (cough, Sabrina Erdley, cough) and published it anyways because you wanted the story.

To 81’s point though, harm or injury is required in either case. If I write a story titled “Hoodafan is six feet tall and the smartest poster on the Soapbox” that would be unquestionably false, but would not harm him so he wouldn’t be able to establish harm to his (already gutter level) reputation.
