1) Certain classes of illegals are excluded from the 5,000 number, so more than an average of 5,000 can cross without triggering the emergency.

2) The person in charge of calculating and providing the metrics -- Mayorkas -- is already guilty of violating our immigration law and lying about the border situation, so there is no reason at all to believe that he would ever declare an emergency. Further, even if he wanted to declare an emergency, Joe Biden -- who is also already guilty of violating our immigration law and lying about our border situation -- can override him. Hence -- and contra Lankford's lies -- there is no enforcement mechanism in the bill to cap illegal entries at an average 5,000 per day.

3) Regardless of whether an emergency is declared, illegal immigration continues unabated at our ports of entry, meaning -- contrary to your mistaken impression above -- there is NEVER any "total closure" of the border. Bill co-sponsor Murphy actually brags about this fact.

4) Also regardless of whether an emergency is declared, such a declaration is mandated to be limited in its timeframe and, as I read the bill, the emergency powers disappear altogether after three years.
