...someone can take classified/sensitive/whatever docs and do whatever they want with them, but all is forgiven if they just give them back (which is inapt to the Clinton case, by the way) is a fallacy. It's either a crime to take/possess them, or it's not. The law doesn't allow for mulligans. So, the TDSers give the game away right off the bat by excusing the lawbreaking of the other three people mentioned.

Beyond that, Trump is the only one of the four who was president and thus the only one of the four with COMPLETE AND TOTAL AUTHORITY to possess and/or declassify WHATEVER government document he wanted.

Further, the crimes with which Trump is charged require WILLFULLY withholding documents to which the possessor has no right and to which some other authority did have a right. Neither of those elements apply to Trump because there was a dispute -- still left unadjudicated -- about 1) whether he had the right to possess the docs and 2) whether the entity asking for them was legally entitled to him. Smith has charged a crime whose foundation is totally unproven.
