This goes beyond just calling him a criminal. That happens all the time.


She alleges he actually did criminal things to sabotage her election. This goes beyond name-calling and Times v. Sullivan. From the item - "She now has to prove her claims that he intentionally sabotaged the 2022 election. That is, if she wants to avoid being hit with a multimillion-dollar penalty for defamation." To me, her inability to demonstrate criminality would go a long way to proving actual malice, too.
