It does seem like Comey invented a standard of prosecution for Hilary in a [genuinely held, to be clear] belief that it was best for the country not to have an uncontested Presidential election. He basically admitted as much when he suggested that previous prosecutions where they weren't able to strongly prove intent were not generally successful. But that also means they did proceed with those prosecutions...
