The sly move would be to nominate Garland. If he's significantly right of
RBG - which he allegedly is (no idea if true), that would move the "balance" of power farther to the right, and Democrats can't possibly protest Garland's nomination (and expect to be taken seriously anyways) so he'd move it to the right without a fight. Of course, if it looks like he's going down hard in the election, he probably figures what the hell I'll nominate Jeanine Pirro.
