It's not that the law is narrowly applied at the discretion of prosecutors


it's that the law is written to apply narrowly, to only certain classes of people. Tall people are outside the scope of the law. Yes, my example was silly but how is hating a random tall person for something a different tall person did any different than hating people because of their race, etc?

A more realistic example might be I hate my boss or my company so I go shoot a bunch of innocent people at my office. How is that different than the guy going into church and shooting a bunch of innocent people? A hate crime law says it's the VICTIMS are different, somehow worth more and therefore we get a greater punishment. As I said above, I would be fine with some kind of terrorism or "public violence" charge if it applied to all classes of people and all motivations equally
