It will be interesting to see what the Justice Department's argument is. They can't get it by tradional subpoena or court order because Apple's response is that it doesn't exist. I suppose they could seek a search warrant and attempt to locate some technical details that might allow them to create what they seek themselves (seems like a long shot). But I am with Apple on this one, what's the legal precedent to force them to create something?
