Interesting. In my experience they were rarely enforced except in


egregious instances of a senior exec going to a direct competitor.

I'm generally OK with this ruling, but I'd think they should still be allowed above a certain level / level of pay. If you're a start up, you don't want your head of engineering leaving for a direct competitor. Or they should be allowed with explicit additional (and optional) compensation in exchange for the non compete, then no one is forced to sign it, but a company who wants better protection against its employees taking their knowledge of IP to a competitor can pay extra for that protection.
