The law says that records deemed personal stay with the president, while the NARA provides storage for records deemed presidential (and the president retains access to those documents, by the way).

But it’s the president who does the deeming, not the NARA, which is subordinate to the president. Further, the president is allotted substantial time after leaving office to so deem, as it would be absurd to require a president to have done so by the time they leave office.
