As Smith states, it is true that Trump is not charged with PRA violations -- which should tell you something -- and that the espionage charges are unrelated to the PRA. That fails, however, to recognize that the PRA provides complete immunity for espionage charges of this sort for presidents. As mentioned above, presidents can't have plenary authority to keep their records -- authority which they do, in fact, have -- but simultaneously be subject to review of those records by an underling That argument is self-defeating.

The espionage statute requires "willfull" retention, but there was no willfull retention in Trump's case. Even if it could be proven that Trump KNEW he had the documents in question -- and, magically, of course, no such knowledge could be proven in Slo Jo's case despite him possessing his classified docs for more than a decade -- you can't prove willfull retention. That's because Trump clearly believed -- and the law clearly states -- that presidents have a right to their records. So, when the DOJ, FBI or NARA come knocking, the PRESIDENT has every right in the world to tell them to fuck off. Hence, he wasn't willfully withholding docs from an entity that he knew was rightfully entitled to them because he didn't think that they were so entitled, nor were they in fact so entitled.

As for searching premises, in what universe would Donald Trump consent to his political opponent's corrupt DOJ searching his entire residence, especially based on completely fake allegations? That is beyond absurd. And who cares if Joe Biden -- after having been given weeks of prep time -- consented to his own DOJ searching his house? That is meaningless.

I'm not even going to bother with your first sentence. That Trump was cooperating with the FBI and NARA and had already sent boxes of documents to NARA is well-established. You can pretend or refuse to know this, but that doesn't change reality.
