...the issue isn't the "number of encounters". The issue is how many illegals can get into and are then released into the country.
Second, the correct number of illegals to trigger a border closure is not 4,000 per day. It's any number greater than zero per day.
Third, the president -- Biden -- can and would override any emergency declaration from Mayokas, which likely wouldn't come in any case because they'd just continue to lie about the situation on the border. We'd never hit the metrics (which are absurdly high anyway) required to declare an emergency. It would also, of course, PROHIBIT any future president -- i.e., Trump -- from declaring an emergency and closing the border unless and until illegal immigration were already at ridiculous levels.
Fourth, the 4,000 number is a mirage, as it excludes certain categories of illegals and, in any case, as bill co-sponsor Murphy bragged, "The border never closes" because illegals can still get in through ports of entry, making this statement by Murphy perhaps the only true statement uttered yet by anyone involved in creating this pile of dog shit.
Fifth, any adjudication of continued Biden administration lawlessness MUST BE adjudicated in the DC circuit, which is lib-dominated. Texas, for example, wouldn't be able to makes its case in its own Fifth Circuit. Slipping this little gem into the bill tells you all you need to know about its true intent.
