This case perfectly highlights the argument I have been making for months..


That everyone can agree with the generic "life and health of the mother and fetus," but that the actual laws as written by Republicans do not actually allow exceptions for the life/health of the mother/fetus as the average person would expect them to.

The Texas Supreme Court ruling cites the Texas law that an exception is for when "the pregnant female . . . has a life-threatening physical condition aggravated by, caused by, or arising from a pregnancy that places the female at risk of death or poses a serious risk of substantial impairment of a major bodily function unless the abortion is performed or induced."

But even though Kate Cox was at risk of not being able to have future children, the Court apparently ruled that the exception for "serious risk of substantial impairment to a major bodily function" didn't apply.

If I'm reading the Court's opinion correctly, that's not because the exception wasn't real, but simply because in the brief submitted by the doctor, the doctor stated that she has a "good faith belief" that Ms. Cox meets the exception’s  requirements, whereas the Court says the doctor instead needed to state that "in her reasonable medical judgment" Ms. Cox meets the exceptions requirements.

That's how these assholes parse the words of the legal exception language to essentially make the exceptions not exist.

The focus of the abortion debate on the number of weeks is a red herring.  The problem is that the common language exceptions of life/health of mother/fetus that people agree with aren't what the actual Republican laws state.  The legal language is both extremely limited and vague, meaning that in reality exceptions don't exist - such as in this case when it would seem obvious to everyone that it should, even as the law is written, but the legal language written by Republicans allows for alternate interpretations.
