The first step, proving Trump knew he lost, will be easy IMO.
So many people in his inner circle told him so. The courts told him so.
It's the second step that will be tough. Did Trump knowingly incite a riot/insurrection at the Capitol by claiming he won the election? In my mind, he absolutely did. However, the prosecutors have to prove he wanted a riot/insurrection. They'll need to do it with Trump's words and actions pre 1/6 and how he reacted during riot/insurrection at the White House.
Let me be clear. There was more than enough evidence for an indictment. Convincing a jury beyond a reasonable doubt will be a lot tougher.
