Interesting point about whether it is even improper to label the Cohen reimbursements as “legal fees”. When a lawyer sends a bill to a client, the bill has line items for the legal work performed (the “fees”) and a separate line item for litigation costs advanced. I doubt any payor separates out the fees from the reimbursed costs for reporting purposes. It all just gets labeled “legal fees”. Of course, Trump was actually reimbursing the consideration for the NDA, not typical litigation costs. But I’m not aware of any rule that prevents a lawyer from paying the consideration for a settlement, than being reimbursed by the client.
