Reposting a NewsHour segment from yesterday I found informative.
“War crimes” are a judicial concept, largely now developed out of the Nuremberg trials after WW2. Nations can’t simply assign blame for war crimes to parties they’d like to punish to force something geopolitically. In fact, it’s very hard to tie crimes against humanity and war crimes, as they are formally defined, to political leadership, because it can be very difficult to prove high level responsibility for directing them. The interviewee thinks any focus on Putin should be “Crimes of Aggression”.
Maybe you can try to lump oligarchs in with that, but might be difficult to make that line stand up in court. You can do whatever you want with sanctions, and say whatever you want, but true characterization as a war criminal is a finding in court.
