ON BAIL.

The 70 or so that have not been were denied bail after a hearing based on proof of some combination of "dangerousness," and flight risk, or likelihood of obstruction of justice, according to a Politifact article debunking the "political prisoner" narrative.

I also believe, though I didn't see its in the article, some of these folks were given a cash bail they were unable to raise.

Perhaps this Waukesha sack of shit, who's likely never to breathe free air again, should have had a higher bail imposed. But...maybe not.

It depends on what he was charged with (I don't know what those charges were, but it will surely come out soon), his prior record and whether or not he was/could have been argued to be a threat to the community (don't know what his prior convictions were either other than he has a felony record--but that could be drug sales, for example) and whether he has no-showed any prior court dates, has longstanding ties to the community, is likely to be a flight risk, etc.

Perhaps it was a horrible mistake by the judge who set the bail, but I kind of doubt it. Those hearings are typically about as rote and by-the-book as any hearing in the criminal justice system can be.
