Is the following discriminatory?

"In our office, male employees can be fired for dating males, but females are not fired for the same action."

That is the counter-argument on which some lower courts have based their affirmative rulings.

Also, why is the federal gov't even involved in this discussion? What interest does it have whether its employees (or private employees) are or aren't gay?
