I’m not sure what that school district’s policy is but the courts have interpreted that as, you have to have something? They realize that school employees are not attorneys or the police. Two different teachers reporting incidents related to depictions of violence and a phone search for ammunition is reasonable suspicion for purposes of a school search. And if the suspect did not violate school policy why were they talking with him and his parents in the first place? and if there was no violation of school policy, why was the school requiring him to obtain mental health counseling within 48 hours? Now I don’t think there’s much interest on the part of that prosecutor to bring criminal charges against school officials, but they could/should have searched and they could/should have prevented him from returning to the classroom without meeting the requirements of whatever safety and security plan the school was mandating. And as school employees they owe a duty to the other kids and they are also caretakers of the other children as it relates to child neglect.
